Time has come for courts to deal firmly with women filing false rape complaints as they are tormentors warranting punishment, a Delhi court has said.
False rape cases makes the crime graph shoot up, play havoc with the crime statistics and tend to trivialize the offence of rape and, "no sooner that the news of a person having been accused of rape spreads in the society, he is looked down upon by all and sundry," it observed.
While the act of rape causes intense emotional distress and immense humiliation to the victim, at the same time one cannot lose sight of the fact that false implication in a rape case causes equal humiliation, disgrace and mental agony to the accused, the court further said.
"He (rape accused) as well as his family is ostracised from the mainstream. He is humiliated and ridiculed everywhere. Even his honourable acquittal by the court is not taken note of and does little to salvage his lost honour and dignity. He has to live with the trauma of having been a rape accused throughout his life," Additional sessions judge Virender Bhat said.
The court made the remarks while directing lodging of a complaint against a woman who had registered a false rape case against a Delhi businessman at the behest of someone who wanted to settle scores with him.
"This court would be failing in its duty if appropriate proceedings are not initiated against the prosecutrix (woman) for giving false evidence against the accused," it said.

JAIPUR: The 22-year-old girl who accused senior IAS
officer BB Mohanty of raping and sexually exploiting her recorded her
statement before a magistrate on Tuesday. The girl alleged that Mohanty
raped her for seven months on pretext of helping her clear IAS
examination and later marrying her.
The police said that they
have launched an investigation to verify allegations and collect
corroborating evidence. The corroborating evidence include mobile call
details and records of the hotels in Bharatpur, Goa, Chennai and Agra
where they stayed together. A team was rushed to Bharatpur and Udaipur
to collect the records. Teams will be sent to Goa, Agra and other places
also.
In an application filed by her lawyer, she demanded
police security saying that the accused in the case is an influential
man and may harm her. She also requested the court to seek a progress
report on the case.
On the other hand, Mohanty's wife Meeta
Mohanty told mediapersons that her husband was innocent and he was being
framed by the girl. The police had sealed the flat in New Sanganer Road
area where the alleged rape took place. Meeta and the other family
members were at their residence in Sirsi Road area in Vaishali Nagar.

SURI: A 20-year-old
tribal girl was allegedly raped by at least 10 members of a kangaroo
court in a Birbhum village on Monday night as punishment for having an
affair with a youth from another community. She is in critical condition
after the assault and is clinging to life in spite of the rapists
stopping her from reaching a hospital.
All 13 accused — including the village headman — have been arrested for rape. The girl's boyfriend has also been arrested.
TOI spoke to the girl in Suri Hospital on Wednesday evening. Although
in severe pain, she feebly said: "I had an affair with a man. We were
dragged to a gathering where our community-headman was present. They
told me to pay Rs 50,000. When I said I couldn't, they brutalized me." A
doctor said she was alive "only because she is a tough tribal girl".

A Danish national has alleged that she was gang-raped by a group of men near New Delhi railway station on Tuesday night.
The Danish woman reportedly left the country on Wednesday morning. She took a flight to Copenhagen. She has also refused to undergo a medical test, police said.
The accused suspects are vagabonds, police said. The victim, who is around 51-year-old, has claimed that the men also robbed her after the sexual assault.

Guwahati: At least 40,096 women were victims of atrocities against them and another 13,798 were raped in Assam between 2005 and October 2013, Forest Minister Rockybul Hussain said today.
Sixty nine women died after rape, 72 were killed on suspicion of practicing witchcraft, besides 1,148 dowry deaths, said Hussain in an oral reply to Gul Akhtara Begum (AIUDF) in the Assembly .
In connection with atrocities against women 37,694 were arrested and 25,943 of them were charge sheeted, while 2,386 were prosecuted by court, he said replying on behalf of Chief Minister Tarun Gogoi who also heads the Home ministry.

A newly married woman has accused her husband, an executive with a private firm, of brutally raping and sodomizing her during their honeymoon in Bangkok and Thailand, police said on Thursday.
The 23-year-old victim, along with her family, approached police late last night after which an FIR under relevant sections of the IPC was lodged against the victim's husband, Punit Bhardwaj.
She was taken to Deen Dayal Upadhyay Hospital where sodomy was confirmed in her medical examination. She was also given medical assistance there, police said.
Her husband, who works as a project manager with a multinational company, is at large and several police teams have been deployed to nab him, police said.

Four men raped a 23-year-old homemaker in a community hall from the night of November 30 to the next morning after her husband struck a deal with them for Rs 1.5 lakh, the police said on Thursday.
When the four refused to pay up, the 26-year-old scaled down his demand to Rs 50,000 and then to Rs 1,500. When they still refused, he claimed they had abducted his wife from outside Mankhurd railway station and gang raped her. The survivor, who is out of danger, is under medical observation.
The police said the husband wanted to earn fast money by offering to "share" his wife. He struck the deal over the phone while leaving West Bengal with his wife on November 28, and told his friends to come to the station. But Mobin Khureshi (40), Sajid Khureshi (24), Nizam Khan (25) and Sujitkumar Chaurasiya (43) spilled the beans and all five were arrested.

Time magazine has listed "India's Rape Epidemic", about the nationwide uproar over a number of rape incidents, especially following a shocking gang rape in Delhi, as the ninth top world news story of 2013.
Mass protests at the time over the shocking gang rape of a woman in a bus in Delhi at the end of 2012, the influential US news magazine noted "demanded greater protection for women and swift justice."
"The trial and sentencing of the culprits — four were given the death penalty — of the six suspects lasted through September," it recalled.
